26 Xanadu Special Terms for Rental 1/ The following items/fixtures such as, but not limited to; - Alarm systems, some window coverings, some lighting, bricked garden beds and edging, all irrigation inc pumps tanks, taps, fittings and pipework are not in working condition and will not be altered, repaired, improved, renewed, or replaced beyond their present condition at the start and during of the lease/rental period. 2/ The home, sheds tennis court, garden sheds, out buildings and all concrete inc tennis court, sheds, paths and driveways are taken in an "AS IS " condition and any further deterioration will not be altered, repaired, improved, renewed or replaced beyond their present condition at the start or during the term of the lease/rental period. 3/ The water consumption and the the gas bottle replacement is at the tenants cost and no liability to the agent or lessor on the safety of removing and installing the gas cylinders. 4/ No business activity or illegal and unlawful activity (1) must be performed at this property. For clarity , any business activity that has not got any approval needed to operate from the business from an approved premises is classed as an illegal activity from an unapproved premises. a All activity or work must comply and conform to the Local, State or Federal law and legislation before commencing. If any of this activity is performed without written prior consent from the lessor or owner and any also any governing body that the activity is required to operate under including Local, State or Federal agency's, the tenant or tenants or any third party acting for the tenants ( including legal representatives) are not entitled to any form of compensation through any legal action that may be taken during. If any of the owners property in damaged or destroyed because of the business activity or illegal and unlawful activity. The tenant or tenants understands that  if the premises are used for any business activity or illegal or unlawful activity without written consent and the lessor or owner are required to intervene in regards to any injury's, death or the repairs or replacement of any part of the premises used for the premises being used for any illegal activity , any financial costs in relation to but not limited by, any injury's, death and the  repairs or replacement that will be required will be at the financial cost to the tenant or tenants including any legal costs, penalties, fines, or any other costs relating to any business activity or illegal and unlawful activity. 1/ For clarity , any business activity ( being approved or unapproved ) that has not got all approvals needed to operate from this leased property or premises, any business activity from this property, building, home or shed, is classed as an illegal and unlawful business activity as it is being operated from this unapproved premises or property being leased. 6/ The external and internal property fences are in a " AS IN AS LEASED " condition, and any further deterioration will not be altered, repaired, improved, renewed or replaced. If the tenant/s have an approved pet, the owner or agent will not be responsible for that pet or if the pet sustains an injury or death due to the fences or any liability due to the pet escaping through the property fences. 7/ No subleasing of the property is allowed. If this done the property will not be leased to the leased tenant anytime into the future any the rental agreement will cease immediately. 8/ If the tenant resides in the rental for more than six months, a bond clean and pest control will be required at the end of the rental. 9/The tenant is responsible for the maintenance of the gardens and lawns.
